elementor-size-default\">A brief regulatory overview for municipalities<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-3087f8f3 e-con-full e-flex e-con rivers and streams. Such public access is also important for adapting to climate change, as it provides access to nearby nature and places to cool off.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">In Quebec, the public can move freely on a lake or body of water, provided they have legal access to it (ar. <\/span><a href=\"https:\/\/www.legisquebec.gouv.qc.ca\/fr\/version\/lc\/CCQ-1991?code=se:920&amp;historique=20181113#:~:text=920.,&#039;utilisation%20de%20l&#039;eau.\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">920 of the Civil Code<\/span><\/a><span style=\"font-weight: 400;\">). A public lot (municipal, federal or provincial) must therefore be riparian to allow the general public access to a lake or river.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Recently, this concern to make lakes and rivers accessible to all has come to the fore through modifications to the<\/span> <a href=\"https:\/\/www.legisquebec.gouv.qc.ca\/fr\/document\/lc\/a-19.1\" target=\"_blank\" rel=\"noopener\"><i><span style=\"font-weight: 400;\">Law on development and town planning<\/span><\/i><\/a><span style=\"font-weight: 400;\"> (<\/span><a href=\"https:\/\/www.publicationsduquebec.gouv.qc.ca\/fileadmin\/Fichiers_client\/lois_et_reglements\/LoisAnnuelles\/fr\/2021\/2021C7F.PDF\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Bill no. 67<\/span><\/a><span style=\"font-weight: 400;\"> or PL-67 - assented to March 25, 2021). As a result, regional county municipalities (RCMs) are now required to indicate in their development plans which rivers and lakes are of interest for recreation and tourism (art. 5, par. 10).<\/span><\/p><p><span style=\"font-weight: 400;\">Please note that this article is not legal advice. <\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ae8d5b0 elementor-widget elementor-widget-text-editor\" data-id=\"ae8d5b0\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">There are three main mechanisms by which municipalities can acquire lots to provide access to rivers and lakes. <\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-916fdaa elementor-widget elementor-widget-heading\" data-id=\"916fdaa\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">The right of pre-emption<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-224fdc1 elementor-widget elementor-widget-text-editor\" data-id=\"224fdc1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Since 2022, municipalities have had a <\/span><a href=\"https:\/\/fqm.ca\/chronique-sam\/le-droit-de-preemption-un-nouvel-outil\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">right of pre-emption<\/span><\/a><span style=\"font-weight: 400;\"> municipalities, made possible by the<\/span><a href=\"https:\/\/www.legisquebec.gouv.qc.ca\/fr\/version\/lc\/C-27.1?code=se:1104_1_1&amp;historique=20230828\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">article 1104.1.1 of the <\/span><i><span style=\"font-weight: 400;\">Quebec Municipal Code<\/span><\/i><\/a> <span style=\"font-weight: 400;\">and article 572.0.1 of the <\/span><a href=\"https:\/\/www.legisquebec.gouv.qc.ca\/fr\/document\/lc\/c-19\" target=\"_blank\" rel=\"noopener\"><i><span style=\"font-weight: 400;\">Cities and Towns Act<\/span><\/i><\/a><i><span style=\"font-weight: 400;\">. <\/span><\/i><span style=\"font-weight: 400;\">This right allows a municipality to acquire a lot or building in priority, when it is put up for sale.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">To implement the right of pre-emption, a municipality must :<\/span><\/p><ol><li><span style=\"font-weight: 400;\">Adopt a bylaw delimiting the territory in which the right of pre-emption is exercised AND<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Clearly indicate the purpose for which the property may be acquired (e.g. parks, sports facilities, access, library, etc.). Each owner concerned must then be notified, and the right of pre-emption is entered in the land register (for a period of 10 years).<\/span><\/li><\/ol><p>\u00a0<\/p><p>Then, if the building or lot is for sale, the municipality receives a notice and has 60 days to make an offer.\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c016eb7 elementor-widget__width-initial elementor-cta--skin-classic elementor-animated-content elementor-bg-transform elementor-bg-transform-zoom-in elementor-widget elementor-widget-call-to-action\" class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Free transfer or contribution for park purposes of part of a lot covered by a subdivision or building permit <\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-de7fc23 elementor-widget elementor-widget-text-editor\" data-id=\"de7fc23\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">According to the <\/span><a href=\"https:\/\/www.legisquebec.gouv.qc.ca\/fr\/document\/lc\/a-19.1\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Law on development and town planning<\/span><\/a><span style=\"font-weight: 400;\"> (articles 117.1 to 117.16), a municipality may adopt a subdivision by-law for all or part of its territory, requiring approval of a cadastral operation (e.g. building permit, work permit, etc.):\u00a0<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Disposal of part of the site (with a maximum of 10% of the value or surface area of the lot)\u00a0<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A financial contribution to a special fund\u00a0<\/span><ul><li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">acquire lots or developments for park purposes<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">to preserve natural environments<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">a mixture of the two.<\/span><\/li><\/ul><\/li><\/ul><p><span style=\"font-weight: 400;\">Thus, one of the conditions for obtaining the permit desired by the owner is the transfer of part of his land to the municipality. <\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-420291ec e-flex href=\"https:\/\/www.ville.rosemere.qc.ca\/download.php?filename=R-1004-Projet-de-reglement-sur-la-contribution-pour-fins-de-parcs-de-terrains-de-jeux-et-despaces-naturels_dec_2022.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">By-law respecting contributions for parks, playgrounds and natural areas<\/span><\/a><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-6daddadd e-con-full e-flex e-con e-child\" data-id=\"6daddadd\" class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Acquisition by mutual agreement or expropriation<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4f4cf84 elementor-widget elementor-widget-text-editor\" data-id=\"4f4cf84\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">The right of expropriation is granted to municipalities (without having to obtain government authorization) via the <\/span><a href=\"https:\/\/www.legisquebec.gouv.qc.ca\/fr\/document\/lc\/E-25\" target=\"_blank\" rel=\"noopener\"><i><span style=\"font-weight: 400;\">Expropriation Act<\/span><\/i><\/a><span style=\"font-weight: 400;\"> (article 4). Municipalities therefore have the right to expropriate for reasons of public interest, such as the construction of a park. Expropriation also occurs when a municipality requires a right-of-way or servitude.
